APPLICATION OF THESE TERMS
These Terms of Service apply when you access our website or purchase products from Montague Collective. They should be read together with our Privacy Policy, Shipping Policy, Return and Refund Policy and any product-specific warranty information.
Nothing in these terms excludes, restricts or modifies any consumer right or guarantee that cannot lawfully be excluded under the Australian Consumer Law.
-
PRODUCT INFORMATION
We take reasonable care to ensure product descriptions, specifications, dimensions, compliance information, finishes, photographs and prices are accurate.
Colours and finishes may vary slightly due to lighting, photography, screen settings and natural manufacturing variations. Customers should review product specifications and dimensions before ordering.
Plumbing products must be installed by a suitably licensed plumber in accordance with applicable laws, standards and installation instructions. Installation by an unlicensed person may affect any voluntary warranty but does not exclude rights that cannot be excluded under the Australian Consumer Law.
Product availability is subject to change without notice.
-
PRICES AND PAYMENT
All prices are displayed in Australian dollars and include GST unless clearly stated otherwise.
The total purchase price will be shown at checkout before payment is submitted. Standard delivery within Australia is complimentary unless a different charge is clearly disclosed before purchase.
Payment must be successfully authorised before an order is processed.
-
ORDERS
Submitting an order is an offer to purchase the selected products. An automated order confirmation acknowledges receipt of the order but does not guarantee acceptance.
We may refuse or cancel an order before dispatch where a product is unavailable, a price or product description contains a genuine error, payment cannot be authorised, fraud is reasonably suspected, or delivery cannot be completed to the supplied address. If payment has already been taken, we will issue a refund.
To request an order cancellation, contact us as soon as possible. Cancellation cannot be guaranteed after an order has entered processing or been dispatched.
-
SHIPPING AND DELIVERY
We currently deliver within Australia.
Stocked products are generally processed within 1–2 business days. Standard transit generally takes a further 3–5 business days, resulting in an estimated total delivery timeframe of 4–7 business days.
Delivery timeframes are estimates and may be affected by public holidays, carrier delays, severe weather, remote destinations or circumstances outside our reasonable control. We will provide tracking information where available.
Risk in the products passes to you when the products are delivered to the nominated address. Ownership passes once full payment has been received and delivery has occurred.
Customers are responsible for providing a complete and accurate delivery address. Additional costs caused by an incorrect address or failed delivery may be charged where permitted by law.
-
CHANGE-OF-MIND RETURNS
Eligible change-of-mind returns may be requested within 30 days after delivery.
To qualify, the product must be unopened, unused, uninstalled and returned in its original packaging with all accessories and documentation. Proof of purchase is required.
Clearance, customised and made-to-order products are not eligible for change-of-mind returns.
Customers are responsible for the cost and safe return of change-of-mind items. Contact Montague Collective before returning a product. Returns sent without prior approval may not be accepted.
Approved refunds will be processed to the original payment method after the returned product has been inspected.
-
DAMAGED, INCORRECT OR FAULTY PRODUCTS
Please inspect your order promptly after delivery. If a product arrives damaged, incorrect or incomplete, contact us with your order number and clear photographs so we can assist.
Our products come with consumer guarantees that cannot be excluded under the Australian Consumer Law. If a product fails to meet a consumer guarantee, you may be entitled to a repair, replacement, refund or another remedy depending on the circumstances and whether the failure is major or minor.
Any rights relating to faulty products operate independently of our change-of-mind return conditions. We will cover reasonable return costs where required by law.
-
WARRANTIES
Any voluntary product or manufacturer warranty is provided in addition to your rights under the Australian Consumer Law.
Warranty coverage, periods, conditions and exclusions are described on our Warranty page or in the information supplied with the relevant product.
Voluntary warranty claims may be declined where damage results from incorrect installation, misuse, neglect, unauthorised modification, unsuitable cleaning products, harsh chemicals or normal wear and tear. These exclusions do not limit any statutory rights that cannot lawfully be excluded.
Proof of purchase and evidence of installation by a licensed plumber may be requested where relevant to a voluntary warranty claim.
